What is an Industrial Disease?

The term ‘industrial disease’ describes a health condition or illness that has arisen as a result of you exposure to certain hazards or risks in the workplace.

By law, your employer is under an obligation to protect you from any reasonable health risks in the workplace.

If something in your employment has resulted in an illness or health condition, you may be able to claim industrial disease compensation.

Can I Claim for an Industrial Disease?

Your employer has a duty under Northern Irish law to take all reasonable steps in protecting you from developing an industrial disease.

This includes, but isn’t limited to:

  • Ensuring the appropriate level of training.
  • Providing a suitable and safe working environment.
  • Operating a safe system of work.

It will not always be obvious whether your employer took the necessary reasonable steps. We have vast experience in these types of claims and can use our expertise to honestly advise you on the merits of your claim.

What Types of Industrial Disease Can I Claim For?

Industrial diseases can be a result of many factors.

If you’ve been exposed to something harmful in the workplace and as a result you have developed an industrial disease, you might be entitled to compensation.

This can range from a newly diagnosed condition to being exposed to something in work that has worsened a pre-existing condition.

Common examples include, but aren’t limited to:

  • Mesothelioma:
    • A deadly form of cancer caused by breathing asbestos dust.
  • Asbestosis and Pleural Plaques:
    • Lung conditions caused by exposure to asbestos fibres. This leads to scarring of the lung tissues and lining of the lungs.
  • Occupational Dermatitis:
    • Exposure to irritating substances or allergens in the workplace, such as chemicals or solvents, can lead to skin conditions.
  • Silicosis:
    • A lung disease caused by inhaling crystalline silica dust. Common in industries such as sandblasting, stone masonry, construction, demolition, ceramic and glass masonry.
  • Noise-Induced Hearing Loss and Tinnitus:
    • Exposure to loud noise and inadequate hearing protection can often lead to hearing loss and tinnitus.
  • Repetitive Strain Injuries:
    • Long exposure to vibrating tools can cause conditions such as vibration white finger (Hand Arm Vibration Syndrome or HAVS) and Carpal Tunnel Syndrome.

Whatever the nature of your workplace illness, our friendly experts specialise in getting you the compensation you deserve.

If you’ve been unfortunate to suffer from any of the above (or any other workplace illnesses), call Keenan Solicitors today on 028 90 49 3349 or tell us about and we’ll contact you for a free no obligation consultation.
