What should I do following an accident?

A general rule of thumb in any case is the more evidence you have showing that the accident took place in the way you allege, the better your chances of success.

We appreciate that these accidents are often very painful and distressing and as a result, it may not be at the top of your list of priorities to record the details of the accident.

Your first priority if you are hurt should be to seek medical attention. That means attending A&E or speaking with your GP as soon as possible following the accident. Make sure that a good and accurate record is kept of how the accident happened at this stage, as this can be very important later on’

A suggestion would be to take a photo of what made you fall – if there’s a hazard that you tripped over set a coin or something similar up against it to allow us to estimate the height of the edge or area as this is very important in helping us advise whether you are likely to have a case.

If there were any witnesses to the injury you incurred it is advisable to have them write down their account, preferably in email and send it to you for your records and for the use of your solicitor. Try to get their names and phone numbers and if possible their emails or home addresses.

Public Liability vs Occupiers’ Liability Claims

There are subtle legal differences in slip, trip and fall claims in Northern Ireland depending on where they happened.
