What should I do following an accident?
A general rule of thumb in any case is the more evidence you have showing that the accident took place in the way you allege, the better your chances of success.
We appreciate that these accidents are often very painful and distressing and as a result, it may not be at the top of your list of priorities to record the details of the accident.
Your first priority if you are hurt should be to seek medical attention. That means attending A&E or speaking with your GP as soon as possible following the accident. Make sure that a good and accurate record is kept of how the accident happened at this stage, as this can be very important later on’
A suggestion would be to take a photo of what made you fall – if there’s a hazard that you tripped over set a coin or something similar up against it to allow us to estimate the height of the edge or area as this is very important in helping us advise whether you are likely to have a case.
If there were any witnesses to the injury you incurred it is advisable to have them write down their account, preferably in email and send it to you for your records and for the use of your solicitor. Try to get their names and phone numbers and if possible their emails or home addresses.
Having this kind of information and witness account may mean your claim is more likely to succeed.
The next step is to contact Keenan Solicitors for a FREE no obligation consultation, where our expert solicitors can advise you honestly on the merits and get your claim started.
Public Liability vs Occupiers’ Liability Claims
There are subtle legal differences in slip, trip and fall claims in Northern Ireland depending on where they happened.
The difference is often key in how your case is investigated and pursued, which is why it is important that you have a solicitor who is an expert in these personal injury claims.
Public Liability Claims
These claims arise out of accidents which happen on publicly owned land. This can range from parks, to footpaths and pavements. A typical cause is uneven walkways or potholes.
The defendant here will usually be the local public authority. These claims will often be hotly contested, so it’s important that you gather as much evidence as possible and then speak to one of our expert solicitors, who can honestly advise you on the merits of your case from the outset and secure the compensation you deserve.
Occupiers’ Liability Claims
These claims arise out of accidents which happened on private property. Occupiers are under obligations to ensure that when welcoming people onto their property, it is safe to do so.
In these circumstances liability rests with the owners of the land and we will often be claiming against their insurers. Common examples will be shops, restaurants and bars.
Our friendly and knowledgeable solicitors pride themselves on providing honest and straightforward legal advice. We’re only a phone call away.
